The key point is that in such circumstances it is not for the claimant to prove a negative, that he has not recouped the profit by a substitute sale, but for the defendant (if he can) to establish that the profit has been recovered and that the full loss was not suffered after all.

This has relevance to our current dispute with Sanctuary UMG.
